Selling or buying a property is one of the most significant transactions of an individual’s life, both financially and emotionally. Purchase Transaction
Benson Buffett has the expertise necessary to assist you through the purchasing of a property. We assist with reviewing the Agreement of Purchase and Sale and advise you on its terms. The most fundamental role we play is ensuring a client obtains “good title”. At a minimum, “good title” means that the property is free and clear of any encumbrances or title deficiencies. You can also expect our assistance with the following:

• Arranging for and reviewing of the title search
• Drafting all documents required for the mortgage
• Registering the Deed of Conveyance and Mortgage with the Registry of Deeds
• Request and review other necessary searches – tax, compliance, zoning etc.
• Request and obtain title insurance, if applicable
• Reviewing the Survey and Real Property Report

Sale Transaction
When representing you for a sale transaction, we are responsible for ensuring you fulfill your contractual obligations created in the Agreement of Purchase and Sale. A few aspects that will be handled by our capable lawyers and staff, include:

• Drafting the Deed of Conveyance
• Drafting the Bill of Sale
• Reviewing the Survey and Real Property Report
• Calculating closing adjustments
• Requesting and paying out any registered mortgages
• Requesting and paying out any outstanding property or water tax
• Ensuring funds are properly received from the purchaser
• Paying out real estate agent’s commission
